General terms and Conditions
Preamble
This document is intended to regulate the relationship between customers, artists and MeetFrida as a platform and intermediary in a binding and fair manner. Therefore, the basis of an order and a contract are always the following general terms and conditions of MeetFrida, the knowledge and acceptance of which is confirmed with every order via the website www.meetfrida.art.
Initiator of MeetFrida and contractual partner as intermediary is the MeetFrida Foundation Stiftung für Kunst, St. Benedictstr. 34, 20149 Hamburg, Germany
§ 1 Scope of application
For the relationship between MeetFrida and the customer, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. MeetFrida recognizes deviating conditions only in exceptional cases and after prior written consent.
§ 2 Conclusion of contract
The presentation of the works in the Online Gallery as well as in the Outdoor Gallery does not constitute a legally binding offer. Rather, it is a non-binding online catalog, on the basis of which, by clicking on the "Buy" button, an inquiry is submitted for the purchase of the work of art displayed on the website. MeetFrida accepts this request after checking the current availability of the work with an order and contract confirmation by e-mail, which also lists the details of the shipping process.
§ 3 Right of withdrawal
Consumers have the right to revoke within fourteen days, and without giving any reason, purchase contracts with MeetFrida, which were concluded on the basis of an order placed in the online store www.meetfrida.art. The revocation period is fourteen days from the day on which the customer or a third party designated by the customer, who is not the carrier, has taken possession of the goods.
In order to exercise the right of revocation, you must inform us (MeetFrida Foundation Stiftung für Kunst, St. Benedictstr. 34, 20149 Hamburg, Tel.: 040 466 372 94, e-mail: hello@meetfrida.art) by means of a clear declaration (e.g. a letter sent by post or e-mail) of your decision to revoke the purchase contract. For this purpose, you can use the attached sample withdrawal form, which, however, is not mandatory.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If the customer cancels the purchase contract, MeetFrida will refund all payments received from the customer. The same means of payment used in the original transaction will be used for the refund, unless otherwise expressly agreed. MeetFrida can refuse the refund until MeetFrida has received the artwork back in its original condition. The artwork must be returned in the original packaging and insured at the client's own expense.
In case of revocation, the Client must return the goods to MeetFrida or hand them over to MeetFrida without delay and in any case no later than fourteen days from the day on which the Client has informed MeetFrida of the revocation of the purchase contract. The deadline is met if the customer sends the goods before the expiry of the period of fourteen days. The customer bears the direct costs of returning the goods.
§ 4 Delivery
The delivery of a work is made directly by the artist. The artist is solely responsible for the damage-free delivery of the work. All delivery conditions are to be negotiated directly with him/her. MeetFrida acts only as an intermediary and as a mediator of the purchase process.
§ 5 Prices, due date and payment, default
The prices stated in the online store are final prices and include VAT. Shipping costs are not included in the price and will be charged additionally.
Payment can be made within the framework of the payment options presented in the web store.
MeetFrida reserves the right to change works and prices at any time and to refuse orders. MeetFrida may, in its sole discretion, limit or cancel quantities purchased per person, per household, or per order at any time. Such limitations may include orders placed by or under the same customer account and/or orders using the same billing and/or shipping address. To the extent that such a change or cancellation of an order occurs, MeetFrida may use the information provided at the time of the order, including, without limitation, the email address, billing address and telephone number, to notify the ordering party.
In the event that the bank account of the ordering party does not have sufficient funds or the ordering party unjustifiably objects to the direct debit, MeetFrida can demand a processing fee of EUR 50.00 from the ordering party. If the customer is in default of payment, MeetFrida is entitled to charge interest on arrears at a rate of 5 percentage above the prime rate per annum announced by the European Central Bank for consumers and at a rate of 9 percentage above the prime rate per annum announced by the European Central Bank for entrepreneurs. In addition, MeetFrida can charge a flat rate of € 5.00 per reminder with the exception of the first reminder. If MeetFrida has demonstrably incurred a higher damage caused by default, MeetFrida is entitled to assert this.
§ 6 Correction of information
MeetFrida reserves the right at all times to correct any errors, inaccuracies or omissions and to change or update any information or cancel any orders to the extent that any information on the site or any related service or medium was at any time inaccurate. MeetFrida is under no obligation to update, amend or clarify any information on the website, including but not limited to pricing information, except as required by law. The Website Update Date provided is expressly not evidence that all information on the Website or any related service or medium has been changed or updated as of such date.
§ 7 Retention of title
Each work remains the property of the author until full payment has been received.
§ 8 No granting of rights
With the purchase of a photographic print, only the real property of the respective print is acquired. No other rights of use are granted. Any reproduction, duplication, distribution, renting, making available to the public or other analog or digital utilization is not permitted, unless this is expressly permitted by law. This provision does not prevent the resale of the work, but also binds any subsequent purchaser.
